Federal prosecutors have filed a criminal complaint accusing a Japanese restaurant in Santa Monica and its chef of serving whale meat,#x a violation of the federal Marine Mammal Protection Act. Construction Equipment
In an unusual operation that was sparked by the team behind the Oscar-winning documentary film about dolphin hunting, “The Cove” the restaurant, the Hump, was investigated by the National Oceanic and Atmospheric Administration, the United States Fish and Wildlife Service, the California Department of Fish and Game, and the federal Customs and Border Protection agency, which all concluded that the restaurant was serving endangered Sei whale as sushi.
The meat was discovered in visits to the restaurant by undercover agents and environmental advocates who pocketed the meat for testing.
Gary Lincenberg, the lawyer for the Hump, said in a statement that the restaurant accepted responsibility for the wrongdoing and would agree to pay a fine and resolve the matter in court.
The complaint charges Typhoon Restaurant Inc. — the parent company of the Hump, which sits next to the runway at the Santa Monica Airport — and Kiyoshiro Yamamoto, the chef, #xwith the illegal sale of a marine mammal product for an unauthorized purpose, Construction Equipmenta misdemeanor offense that carries a maximum statutory penalty of one year in federal prison and a maximum fine of $100,000 for an individual and $200,000 for an organization.
Martina Sagapolu, acting special agent in charge of the region’s law enforcement office for the Oceanic administration, said in a statement, “Making illicit products like whale meat available on the market only encourages the illegal hunting of marine mammals such as the Sei whale — a species that is already threatened by extinction.”
The Hump is known for serving exotic forms of sushi,Mold, which are popular in Los Angeles.
“Someone should not be able to walk into a restaurant and order a plate of an endangered species,” the United States attorney, André Birotte Jr., said. He added, #x“People should be aware that we will use these criminal statutes where appropriate to protect endangered species,Construction Equipment including to ensure that they do not end up part of a meal.”
